CIVILIAN PENSION BOARD



The Civilian Pension Board met on August 23, 2005 at 9:00 a.m. with Councilman Ruane presiding in the absence of a Chair. Members present were Mr. Hogan, Mr. DePrima, Mrs. Mitchell, Mr. Lucas, Mrs. Rigby, and Mrs. Braun Others present were Mr. Szyjka, Mrs. Hawkins, and Mrs. McMaster.


AGENDA ADDITIONS/DELETIONS

Mr. Ruane added the approval of the minutes to the agenda. Mr. Lucas moved for approval of the agenda as amended, seconded by Mr. Hogan and unanimously carried.


Adoption of the May 24, 2005 Meeting Minutes

Mr. Hogan moved for adoption of the May 24 ,2005 meeting minutes, seconded by Mr. Lucas and unanimously carried.


Proposed Ordinance Amendment - Chapter 2 - Administration, Article IV - Officers and Employees, Division 7 - General Employee Pension Plan, Subdivision II, Board of Trustees, Section 2-368 - Powers - Approval and Definition of Routine Applications for Early or Regular Retirement - Designation of Fiscal Agent; Authorization

During previous meetings, members have questioned the requirement to bring routine pension applications for early or regular retirement be for the Board for action. The City Solicitor has provided a legal opinion that stated that the Board could designate the City Clerk or the Director of Human Resources to approve routine applications complying with the provisions of the Code and that this could be accomplished by a simple motion passed by the Board designating the person or office to act as designee of the Board in this regard.


Mr. Hogan moved to delay action, at the May 24, 2005 meeting, to allow Human Resources time to provide a definition for routine pension applications and a description of a proposed process for the approval of such applications.


Based on the Board’s direction, it is recommended that the Human Resources Director and the Finance Director review and approve all routine pension applications, in writing. Routine applications will be defined as retirements under Section 2-236 Normal Retirement, Section 2-327 Early Retirement and Section 2-328, Later Retirement. If any questions or concerns are presented, a Pension Board meeting will be held for the entire board to review and consider for approval.


Staff recommended that Human Resources prepare the necessary paperwork and will also report on January 2 and July 1 of each year to the Civilian Pension Board members all routine pensions reviewed and approved for the prior six months. This reporting will occur during a regularly scheduled meeting.


Mr. Hogan moved that the Civilian Pension Board assign the Human Resources Director and the Finance Director to review and approve all pension applications, in writing, that are considered routine in nature, and that each employee be informed that if they disagree with any assignments made by the Human Resources Director and the Finance Director they have a right to appeal directly to the Board; and that a quarterly report be prepared and presented to the Board during their regularly scheduled meetings. This motion was seconded by Mr. Lucas and unanimously carried.
