POLICE PENSION BOARD
The Police Pension Board met on May 24, 2005 at 9:30 a.m. with Chairman Mullaney presiding. Members present were Mr. Ruane, Mr. Hogan, Mr. DePrima, and Chief Horvath. Ret. Capt. Gray and Ret. Lt. Knotts were absent. Others present were Mr. Szyjka, Mrs. Hawkins, and Mrs. McMaster.
AGENDA ADDITIONS/DELETIONS
Mr. Ruane moved for approval of the agenda, seconded by Mr. Ruane and unanimously carried.
Organizational Issues – Election of Chairman
Chief Horvath moved to nominate Mr. Mullaney to serve as Chairman of the Police Pension Board, seconded by Mr. Hogan. Chief Horvath moved to close nominations, seconded by Mr. Hogan and unanimously carried. The motion to nominate Mr. Mullaney to serve as Chairman of the Police Pension Board was unanimously carried.
Application for Pension Benefits – Robert Burge
An application for pension benefits was received from Robert Burge with 18 years, 4 months of service. He will be retiring under Section 18-29(2), 15 Years of Service and 60 Years of Age.
Mr. Mullaney advised members that Mr. Burge had left the City’s employment in 1988, prior to 20 years of service, and that he has become eligible to receive pension benefits since attaining the age of 60. Responding to Mr. Mullaney, Mrs. Hawkins explained that Mr. Burge did not contact the City until February 2005 regarding his entitlement to pension benefits. Since he attained the age of 60 in November 2004, his pension benefits will be retroactive to November 5, 2004.
Chief Horvath moved for approval of the application for pension benefits for Mr. Robert Burge, to be effective November 2004, seconded by Mr. Hogan and unanimously carried.
Receipt of Legal Opinion – Designation of Fiscal Agent; Authorization to Approve Routine Applications for Early or Regular Retirement
During previous meetings, members have questioned the requirement to bring routine pension applications for early or regular retirement before the Board for action. At the request of the Human Resources Department, City Solicitor Rodriguez provided a legal opinion. In accordance with Section 2-208, Subsection 6, of the Dover Code, Mr. Rodriguez indicated that the Board could designate the City Clerk or the Director of Human Resources to approve routine applications complying with the provisions of the Code and that this could be accomplished by a simple motion passed by the Board designating the person or office to act as designee of the Board in this regard.
Since there is only one (1) more officer eligible for retirement, it was the consensus of members that no further action be taken.
Chief Horvath moved for adjournment, seconded by Mr. Hogan and unanimously carried.
